Terms & Conditions

Liability Waiver

I realize the nature of the Westsound Pickleball Community(WPC) activities and the equipment used in conjunction with those activities may expose me to hazards or risks that may include minor injuries, broken or sprained limbs, overexertion, or heat exhaustion, along with other, more serious injuries, including hospitalization and death.

 

In consideration of my participation in WPC related activities, I hereby accept all risk to my health or property and release the WPC, its Board of Directors, officers, agents, employees, and independent contractors, from any and all liability to me, my personal representatives, estate, heirs, next of kin and assigns that may result from or occur in any way related to my participation in WPC activities.

 

I further agree to hold the WPC, its officers, directors, agents and employees harmless from any and all claims related to or in any way arising out of my participation in any WPC activities and agree to indemnify them against all loss including judgments, litigation expenses, attorneys fees and out of pocket expenses.

 

I have carefully read this agreement and understand it to be a release of all claims and causes of action for injury or death or damage to my property which may occur as a result of participating in any WPC activities and I further understand that this agreement obligates me to indemnify and hold harmless the Westsound Pickleball Community, its officers, directors, agents, employees and
independent contractors of WPC in connection to any claim for personal injury liability or property damage arising out of, pertaining to, or related to my participation in WPC activities. I am entering into this agreement freely and without any inducement or assurance of any nature. Furthermore, I agree that if any portion of this agreement is held to be invalid, the balance, shall remain in full force and effect.

 

I further understand that this agreement shall be valid in regards to my participation in any and all WPC related activities. I also acknowledge I may be required to sign separate and additional release agreements for future WPC sanctioned tournament events in which I choose to participate.

Code of Conduct

The sport of pickleball will succeed best if its players embrace the values of good sportsmanship. It is essential  all Westsound Pickleball Community members and volunteers model good behavior, lead by example, display respect and show self-control.

 

Every person involved in pickleball (participant, official, volunteer, representative of the Westsound Pickleball Community or spectator) pledges as follows:

  • I will not engage in unsportsmanlike conduct or encourage others to do so.

  • I will not engage in any behavior that would endanger the health, safety or wellbeing of others.

  • I will not engage in the use of profanity.

  • I will treat others with respect.

  • I will exhibit fairness and honesty in my dealings with others.

  • I will not flaunt my position.

  • I will not use Westsound Pickleball Community records or materials for personal gain.

  • I will not disrupt or interfere with the efforts of the Westsound Pickleball Community to promote the sport of pickleball.

The above Code applies in all situations that relate directly or indirectly to pickleball play.​​
 

Consent to Receive Electronically Transmitted Notice

I do hereby CONSENT to receive electronic transmissions of any and all notices, including but not limited to, notice of annual or special meetings, proposed action of the Board of Directors or Members, notification of changes in club dues, and electronic requests for Member or Board of Director votes, via electronic transmission to the email address used in my registration.

 

I further consent to the use of electronic forms of voting, whenever applicable, for all matters in which I am eligible to vote. I understand my vote must be received in the same timeframe as live votes, and that the Board will count my vote as if it were cast in person.              

                     

This electronic consent may be modified or revoked by delivering a signed notice indicating such modification or revocation to the Board of Directors at the Registered Office, or to the Secretary of the Board.
